TERMS & CONDITIONS

OWS Terrariums | Last updated: 19/08/26

These Terms & Conditions apply to purchases of terrariums and related products from OWS Terrariums (referred to as “we”, “us” or “our”). By placing an order with us, you agree to these Terms & Conditions, subject to your statutory rights as a consumer.

1. About us

We are a UK-based small business selling ready-made terrariums and related products.

2. Our products

We sell ready-made terrariums. Each terrarium is individually assembled using living plants, natural materials and, where applicable, decorative or biological components.

· We do not currently offer bespoke, personalised or customer-requested terrariums.

· The product shown and described for sale is the product supplied.

· Product photographs are intended to represent the item accurately, although minor differences in natural materials, plant growth and appearance may occur.

· Measurements, dimensions and product descriptions will be provided where relevant to the product.

· Because plants are living organisms, their appearance can change over time.

We will not describe a natural change in appearance as a defect where the product remains consistent with its description and intended purpose. This does not affect your statutory rights where a product is genuinely faulty, not as described, of unsatisfactory quality or not fit for purpose.

3. Availability

All products are subject to availability. A product being shown on our social media or other marketing does not guarantee that it remains available for purchase.

If an item becomes unavailable before an order is accepted, we will inform you and, where payment has already been taken, provide an appropriate refund.

4. Product information and pricing

We aim to ensure that product descriptions, photographs, dimensions and prices are accurate at the time of publication.

· Prices will be stated in pounds sterling (£).

· The total price payable will be confirmed before the customer is asked to pay.

· Any applicable delivery charge will be stated separately or clearly included in the total price.

· We reserve the right to change prices for future purchases, but a price change will not affect an order that we have already accepted.

· We will not charge for optional extras unless the customer has actively agreed to them.

5. How orders are placed

At present, orders may be placed through direct communication with us, including social media messages, or through any other ordering method we make available.

Before payment is taken, we will provide the customer with the relevant product information, price, delivery arrangements and applicable customer information.

Customers are responsible for checking that the product, quantity, delivery details and other order information are correct before confirming their purchase.

6. Order acceptance and contract

An enquiry or request to purchase does not automatically mean that an order has been accepted.

A contract is formed when we confirm acceptance of the order and agree to supply the product, subject to any applicable conditions.

We will provide the customer with confirmation of the contract and the applicable terms in a format that the customer can save for future reference.

If we are unable to accept an order, we will explain this where appropriate and refund any payment already taken for goods that we cannot supply.

7. Payment

Payment must be made using the payment method we make available at the time of purchase.

Unless otherwise agreed, payment must be received before the order is dispatched.

If payment is not successfully received, we may treat the order as unconfirmed and will not be required to reserve the product indefinitely.

8. Delivery

Delivery options, costs and estimated dispatch/delivery times will be provided before the customer completes the purchase.

· We will dispatch orders within the timeframe agreed with the customer.

· Where no specific timeframe has been agreed, we will deliver within the period required by applicable consumer law.

· Delivery times supplied by third-party couriers are estimates and may be affected by circumstances outside our reasonable control.

· Customers must provide an accurate delivery address and any delivery instructions required to complete the order.

· If a customer provides an incorrect address, this may cause delay or additional delivery costs.

If an order is delayed, lost or otherwise affected during delivery, we will work with the customer and the delivery provider to resolve the issue. Nothing in these Terms & Conditions removes any statutory rights relating to delivery.

9. Delivery of living products

Our terrariums contain living plants and may contain glass. We package products with reasonable care for transport and will provide appropriate handling and care information.

Customers should inspect their terrarium when it arrives. If it has been damaged in transit, the customer should contact us as soon as reasonably possible and provide photographs of the packaging, delivery label and damaged item where possible.

Delivery damage will be dealt with under the applicable consumer rights and our Returns & Refunds Policy.

10. Care of your terrarium

Each terrarium will be supplied with care information. Customers should follow the care instructions provided, including guidance on light, watering, temperature, ventilation and placement.

A terrarium is a living ecosystem. Natural changes may include plant growth, leaf loss, new growth, changes in moss, changes in condensation and other changes in appearance.

Some individual plant or leaf loss can occur naturally as part of the life cycle of a living ecosystem. Natural change does not automatically mean that a product is faulty.

If a customer believes a plant arrived damaged, diseased or otherwise defective, they should contact us promptly so that we can assess the issue.

Where damage or deterioration is caused by inappropriate care, neglect, accidental damage or failure to follow supplied care instructions, this may affect the remedy available. This does not affect statutory rights that cannot legally be excluded.

11. Returns, cancellations and refunds

Our Returns & Refunds Policy forms part of these Terms & Conditions and explains how cancellations, change-of-mind returns, refunds, damaged products and faulty products are handled.

Where a statutory cancellation right applies to a distance purchase, the customer will be given the required information about how and when to cancel.

Because our products contain living plants, certain legal exceptions may apply to particular products or circumstances. We will only rely on an applicable exception where it legally applies.

Nothing in these Terms & Conditions removes or restricts statutory consumer rights.

12. Faulty, damaged or incorrectly supplied products

If a product is faulty, damaged, not as described, or the wrong product has been supplied, please contact us.

We will assess the issue and provide the remedy required by applicable consumer law. Depending on the circumstances, this may include repair, replacement, price reduction or refund.

We will not ask a customer to waive or give up a statutory right as a condition of resolving a valid complaint.

13. Natural variation and living ecosystems

Each terrarium is unique. Natural materials may vary in colour, shape, texture and appearance. Living plants may also vary in size and appearance as they grow.

These natural variations are part of the character of a living terrarium and will not be treated as a defect where the product remains as described and fit for its intended purpose.

14. Customer responsibilities

· Provide accurate name, contact and delivery information.

· Check order details before confirming a purchase.

· Provide safe and suitable delivery instructions where needed.

· Follow the care information supplied with the terrarium.

· Contact us promptly if there is a problem with an order or product.

· Take reasonable care of the terrarium while it is in the customer's possession.

15. Our responsibilities

We will supply products in accordance with the contract and applicable consumer law.

We will communicate with customers honestly and clearly and will make reasonable efforts to resolve problems fairly.

Nothing in these Terms & Conditions excludes or restricts liability that cannot legally be excluded or restricted, including liability for death or personal injury caused by negligence, or liability relating to statutory consumer rights.

16. Events outside our reasonable control

We will not be responsible for delays caused by events outside our reasonable control, such as severe weather, transport disruption, industrial action, widespread service outages or other unforeseeable events.

Where such an event affects an order, we will communicate with the customer and take reasonable steps to minimise the impact. This does not remove any statutory rights the customer may have.

17. Complaints

If you are unhappy with an order or our service, please contact us so that we can investigate and try to resolve the issue.

Email: OWSTerrariums@gmail.com

Please include your order number and a clear description of the issue.

We aim to respond within 5 working days and will try to resolve complaints fairly and promptly.

18. Privacy

We process customer personal information in accordance with our Privacy Notice. Our Privacy Notice explains what information we collect, why we collect it, how we use it, who we may share it with and the rights available to customers.

The Privacy Notice is available

19. Intellectual property

Unless otherwise stated, our business name, branding, original photographs, written content, graphics and other original materials remain our intellectual property or are used with permission.

Customers may not reproduce or commercially use our original materials without our permission.

20. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time. The version that applies to an order is the version provided to or made available to the customer before that order is accepted.

Changes will not retrospectively alter the terms of an order that has already been accepted.

21. Governing law and jurisdiction

These Terms & Conditions are governed by the law of England and Wales, unless applicable law requires otherwise.

Where a dispute arises, the courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings elsewhere.

22. Statutory rights

These Terms & Conditions are intended to operate alongside UK consumer protection law. If any provision of these Terms & Conditions conflicts with a mandatory legal right, the legal right will take precedence.

Consumers have statutory rights relating to goods, including that goods must be as described, of satisfactory quality and fit for purpose. Nothing in these Terms & Conditions limits those rights.
